Terms and Conditions

1. INTELLECTUAL PROPERTY

Runaway Picnic is the owner and designer of all pop-up picnics created under its name. No picnic setup design or content displayed on Runaway Picnic’s website shall be replicated in any form without the expressed written consent of Runaway Picnic and its owner. If our clients wish to promote our pop-up picnic setups or business, Runaway Picnic should be credited in its proper form including, but not limited to, online tagging and mentioning of our business @runawaypicnic. In the form of digital and printed media and publications, the full name Runaway Picnic should be used to refer to our business and pop-up picnics.

Runaway Picnic reserves the right to promote its business in any form deemed suitable for the business including, but not limited to, posting on its website, social media platforms and any other media in addition to collaborating with other businesses to continue delivering great service to our clients.

All photographs, footage and paintings taken by Runaway Picnic are and shall remain the sole intellectual property of Runaway Picnic. The client hereby waives any rights to intellectual property ownership, monetization or reproduction of the images, footage and paintings created by Runaway Picnic, with the exception of the terms of any formal releases provided to the client by Runaway Picnic.

When accepting our Terms & Conditions and booking an appointment with Runaway Picnic, our invoice acts as a contract and serves as a model release. This grants Runaway Picnic the right to use all images, footage and paintings without restriction for advertising, portfolios and other lawful purposes. The client waives the right to inspect any images and paintings produced using the images, footage or paintings from the booked pop-up picnic, and the right to restrict the use of the images, footage and paintings from all forms of advertising, social media and digital and printed publications.

2. process & Liability

Runaway Picnic requests all of its clients to book their picnic online by first selecting their preferred theme, location and type of picnic package each client wants. Runaway Picnic offers picnic packages for two persons and group picnic packages starting from four persons with options to add extra guests for a maximum of 8 persons per picnic date. Runaway Picnic also offers elopement pop-up picnic design packages for couples wishing to elope or have an elopement-style picnic photoshoot. Elopement packages are designed for 2 persons; however, extra guests can be added for a maximum of 8 persons per Elopement picnic party.

After selecting the picnic package, clients can select a picnic design option. Runaway Picnic’s design theme offerings change seasonally and are updated in the Packages page on its website. For the latest design theme offerings, please visit https://runawaypicnic.com/packages 

To enhance the Runaway Picnic experience to its clients, Runaway Picnic offers customization options in addition to a wide range of add-on services to add to their booking at an additional cost. The client can check their desired add-on services and write a special note for their custom requests when booking. All custom requests are subject to Runaway Picnic’s approval and may not be guaranteed depending on the type and complexity of the client’s request. Runaway Picnic deals with local business to source and/or rent services and/or products for its clients for out-house add-on services. Runaway Picnic is not liable for any of it’s vendors’ products or services.

Runaway Picnic’s clients must specify their desired pop-up picnic location and must ensure that the selected location is available for hosting a pop-up picnic service. Runaway Picnic is not responsible for obtaining permits, paying parking and/or access fees or any other fees associated with the selected location. It is the responsibility of the client. If Runaway Picnic is asked to pay for any fees on site when setting up the pop-up picnic for its client, the fee charges will be passed on to the client to pay back Runaway Picnic.

Runaway Picnic can set their pop-up picnic design rental service in outdoor or indoor locations. Outdoor locations can be major parks, beaches or client’s private property. In case of sudden bad weather or rainfall, a nearby indoor picnic location back-up plan should be prepared by the client in case the pop-up picnic is not set up near a shaded structure outdoors to take shelter if needed.

For outdoor locations that require heavy trekking or have challenging terrain (i.e.: sand, sloped ground, slippery ground, mud and water access) the choice of the picnic setup format might be affected. In most cases, the dining setup format would be switched to a cozy picnic setup format. Extra transportation and handling fees might apply depending on the location of the chosen pop-up picnic setup and the complexity of reaching the location on foot. Runaway Picnic has full rights to reject a location or recommend a new location alternative if it deems the chosen location to be inaccessible, unsafe or for any other reason.

Runaway Picnic is not responsible nor liable for any garbage or waste produced by its client and guests on site (such as food and drink waste, pet waste, fire hazard, smoking remnants, hazardous substances, etc). Runaway Picnic’s clients are responsible for respecting their selected location’s rules and regulations and leaving the site clean at rental handover. Runaway Picnic is only responsible for its rental items and cleaning their flatware, tableware and décor items only.

After the  design theme, location, design package and preferred add-on services have been selected and approved, the client can proceed to find an available picnic date and timeslot in order to book their Runaway Picnic experience. The client will have to read the Terms and Conditions and agree to them before proceeding for payment. 50% of booking total price would be paid at time of booking through online banking e-transfer to secure their booking date in addition to a 20% service fee (weekends and small gatherings; 30% service fee for weekdays, last minute bookings and large gatherings over 8 guests). Runaway Picnic also requests to have the client’s credit card on file when booking.

The remaining 50% balance of the invoice is due no later than 7 days prior to the booked Runaway Picnic date. If the client fails to pay the remaining invoice balance, Runaway Picnic will cancel the client’s Runaway Picnic experience booking and will not issue a refund. 

Once the booking payment has been verified, Runaway Picnic will send an invoice with the agreed Terms and Conditions. A refundable security deposit fee will be added to the invoice and will be returned to the client after the client delivers their picnic to Runaway Picnic once their picnic date is over and all rental items are found to not be missing or damaged. Floral centerpieces, faux cakes, napkins, linen, painting workshop tools and picnic favors (unless agreed otherwise between Runaway Picnic and the client) in addition to everything else included with the picnic rental excluding consumable food and drink, commissioned paintings and workshop canvas/ceramic artwork are considered Runaway Picnic’s rental property items and should be returned to Runaway Picnic once the picnic date is over.

Following the client’s booking, Runaway Picnic will schedule a 15 mins call with the client to go over the client’s Runaway Picnic experience details, Terms and Conditions and answer any questions. 

On the day of the picnic, Runaway Picnic will set up the picnic for its client, send a picture with a shared location of the picnic if possible and greet the client before hand-delivering the rental setup. After greeting the client, Runaway Picnic will leave the picnic site for the client to enjoy in peace. Once the picnic date is over, Runaway Picnic will return to site, ensure no items have been damaged or are found missing and pack everything and go. After making sure all the rental items have been cleaned and inspected for any missing items or damage, Runaway Picnic will refund the security deposit to the client within 7 days of the picnic date. Runaway Picnic is not responsible nor liable for cleanup or damage made on the selected location property. Runaway Picnic expects the client to dispose their garbage and waste (such as organic waste, fire hazard, hazardous waste and other waste caused by the client) in the appropriate recycling bins found in the selected location. 

Furthermore, the client is requested to ensure that Runaway Picnic is on-site before leaving their picnic. If the client wishes to leave before their 2 hour Runaway Picnic experience (or more depending on the chosen or agreed package), the client must contact Runaway Picnic 30 mins or more through phone or text before leaving and inform Runaway Picnic that they are planning on leaving (for locations that are beyond a 20km radius from South Keys Ottawa, a minimum of 1 hour notice is requested). 

The client is fully responsible for all of Runaway Picnic’s rental items and the extra add-on items from Runaway Picnic’s vendors and suppliers. If the client fails to communicate with Runaway Picnic and items are found lost, stolen or damaged, extra charges will be charged towards the client as part of recovery fees. Many of Runaway Picnic’s items are handmade, fragile and expensive. Therefore, Runaway Picnic asks all of its entrusted clients and guests to treat their picnic setup items with great care. Extra care is requested when handling and dining with Runaway Picnic’s handmade wood table. Runaway Picnic requests that neither the client nor guests (children and pets included) to sit, stand or abuse the picnic table as it may be a safety hazard if improperly dealt with. Runaway Picnic also asks that pets should not be sitting on their cushions, rugs, table and sheepskin rugs as these items are fragile. A dry-cleaning fee will apply for stained fabric items including cushions, rugs and linen.

3. custom design

Runaway Picnic offers unique custom design services to its clients. If a client wishes to do a romantic picnic or proposal, Runaway Picnic can design a picnic setup and experience for its clients to enjoy at an additional cost, subject to booking and resources availability. 

For custom designs, a minimum of 2.5 weeks of booking notice must be made. This ensures Runaway Picnic has enough time to design, plan resources and prepare for the client’s magical Runaway Picnic custom experience. Custom designs might include graphic design and signage and/or décor items. Custom designs are charged extra. Runaway Picnic to provide client with quote.

4. extra services

Runaway Picnic offers in-house and out-house add-on services to add to its clients’ Runaway Picnic experience. Some add-on services might require long lead times and are subject to availability. Runaway Picnic offers custom watercolor paintings of its picnic guests, live ceramic paint workshops and paint nights. In addition to its in-house art services, Runaway Picnic collaborates with a few local businesses and artists including local jagua henna tattoo artist Inkspírehaüs and others for jagua henna tattoo, premium floral arrangements, private butler, balloons, catering and graphic design printing services. 5. delivery & extra labor logistics

Runaway Picnic caters towards its clients who might want to experience a Runaway Picnic at a remote location such as a private cottage. Runaway Picnic has a maximum travel distance of 30 minutes from Findlay Creek Ottawa. 

Delivery to selected picnic locations in areas located within a 20km radius of Findlay Creek Ottawa and are easily accessible by road and on foot will have free delivery included in the booking. For areas that are beyond a 20km radius from South Keys Ottawa, a transportation fee will apply ranging from $160 to $200+ depending on location distance and complexity of reaching the location.

For clients looking for a romantic runaway picnic getaway and would like Runaway Picnic to set up a client’s picnic at their cottage without being disturbed for the night, Runaway Picnic can come the next morning to pick up the client’s picnic rental at an additional fee. Since clients booking Runaway Picnic’s rental service for more than 2 hours and are opting for an overnight rental, Runaway Picnic would be charging the price of an additional picnic package in addition to transportation and handling fees. Transportation and handling fees cost start at $250. 

Runaway Picnic also offers an extra picnic rental hour to be added to the client’s Runaway Picnic experience if needed. An extra Runaway Picnic experience hour is charged at $100, subject to booking availability.

6. cancellation & rescheduling policy

Runaway Picnic accepts cancellations for all of its picnic package within 24 hours of booking the picnic date. After that, no cancellations are accepted. Runaway Picnic spends a lot of time and effort into planning for each picnic date. This includes the time and money spent connecting with Runaway Picnic’s designers, vendors and suppliers to secure and provide its clients with the items and services needed to create the client’s picnic. 

Runaway Picnic receives numerous booking requests and due to limited available spots, Runaway Picnic is unable to accept cancellations after the 24 hour time frame period. If something comes up and the client needs to reschedule, Runaway Picnic offers a one time rescheduling opportunity for free. 

For rescheduling, Runaway Picnic allows a one-time rescheduling of the picnic booking minimum a week in advance from the client’s picnic date (if premium floral arrangements or fresh rose petals are added to the client’s order, a minimum of 15 business days in advance is required for rescheduling the client’s booking with no penalty). If the client needs to reschedule more than once, there will be a 50% additional sub-charge of the picnic booking value per each rescheduling date. Similarly, if the client needs to reschedule less than one week (or two in case the client requested premium florals or fresh rose petals add-on), an 80% sub-charge of the picnic booking value will be charged to the client.

In the event of a lockdown, all booked group picnics will be eligible for rescheduling at no cost. Rescheduling date is valid for one year starting from the date of when you booked your picnic.

Runaway Picnic reserves the right to amend, modify or cancel its cancellation and rescheduling policy or Terms and Conditions at any time without notifying its clients. Clients must check with Runaway Picnic for the latest Terms and Conditions
